Factoring and invoice discount overcharge

A building contractor contacted ourselves. The company which turned over £3 million had been uncomfortable with their financial arrangements with a large invoice discounting and factoring company. After a careful review of their facilities we found a contractual error which resulted in a potential overcharge of several thousand pounds. Despite the factoring companies reluctance to initially address the problems raised, we were successful in recovering after several months of negotiations a settlement figure of £18,000.

Mis-selling of investments

A lady who had life savings of approximately £70,000 was mis-sold high risk investments by her bank. After our involvement the bank agreed to refund the money that their client had lost so that she did not suffer any financial loss.

Business account overcharges

A company running contract cleaners contacted ourselves to review the charges on their account. Despite having an excellent working relationship with their bank and having received a refund in the mid-90s of £12,000 they wished a further review to take place on their account. Their borrowing facilities varied but were approximately £50,000 by way of overdraft. We argued successfully that an overcharge had occurred on the account as the bank had allowed the borrowing to increase over the marked facilities. Therefore the charges that the bank had debited as unauthorised borrowing were incorrect. Subsequently our client was refunded £10,000

Debt write-off

A brother and sister approached our firm as they were being pursued for approximately £20,000 borrowing between them by a high street bank. Despite the involvement of the Financial Ombudsman and the courts they had not been successful in removing this threat. The problem they found was that debt had been allowed to increase without agreed facilities by way of withdrawals of a third-party by cashing cheques through the bank's branches. We argued that the bank did not offer our clients a duty of care in controlling this situation and we were successful in that the bank agreed to write off the whole debt.

Personal guarantee write-off

A client, we established, was encouraged by their bank to borrow monies for their new company under personal guarantee supported by their family residential property. Later the company was thrown into difficulty when the bank's lending policy altered. The bank pursued the client under the guarantee in full. Following our involvement, highlighting the errors of the bank to weaken their position we were successful in the reduction of debt by approximately £55,000. The client was happy to pay the reduced amount and their family home was no longer threatened following our involvement.
